La ética del cuidado es la propuesta teórica feminista más conocida en bioética. Mediante una revisión y análisis bibliográfico abordaré la ética del cuidado e interseccionalidad, como marco para discurso bioético aplicado a las estructuras en la atención de salud y para la toma de decisiones. La ética del cuidado y la interseccionalidad otorgan elementos pocas veces considerados en el análisis bioético, como es el contexto, la subjetividad, la experiencia vivida, las relaciones de cuidado y la responsabilidad con sí misma (...) y los otros. In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

This article asserts the presence of empirical evidence supporting the extension of Worringer’s concepts beyond the realm of art appreciation to the domain of art-making. Consequently, it posits that abstraction and empathy serve as foundational principles guiding the production of both abstract and figurative art. This (...) holds particular significance in the 21st century, where artificial intelligence (AI) assumes a creative role that was absent during Worringer’s initial formulation of his theory. The present paper deals with the ontological status of numbers and considers Frege ́s proposal in Grundlagen upon the background of the Post-Kantian semantic turn in analytical philosophy. Through a more systematic study of his philosophical premises, it comes to unearth a first level paradox that would unset earlier still than it was exposed by Russell. It then studies an alternative path, that departin1g from Frege’s initial premises, drives to a conception of numbers as synthetic a priori in a more (...) Kantian sense. On this basis, it tentatively explores a possible derivation of basic logical rules on their behalf, suggesting a more rudimentary basis to inferential thinking, which supports reconsidering the difference between logical thinking and AI. By this I mean the effort to identify the legal norms on which the existence and functioning of binding precedents depend and to show that these norms constitute a group of Hohfeldian legal relations between the courts whose precedents must be followed, the courts that must follow them, and the individuals whose (...) legal situations are as a result modified by the observance and the breach of those precedents. Im Alltag wie in ethischen Fachdiskussionen verweisen wir häufig auf moralische Intuitionen. Doch welche Art mentaler Zustand sind moralische Intuitionen eigentlich? Wie 'generieren' sie moralische Wertungen? Unter Rückgriff auf zeitgenössische Theorien aus der Philosophie des Geistes argumentiert die Autorin, dass moralische Intuitionen zu konkreten Fällen eine Form der Emotion sind. Sie spezifiziert, in Anlehnung an Millikans biosemantisches Intentionalitätskonzept und Prinz? Emotionstheorie, was diese moralisch wertenden Emotionen auszeichnet und welche mentalen Prozesse ihrem Auftreten zugrunde liegen. Burgbachers Modell gibt eine zeitgemässe, empirisch (...) orientierte Antwort auf die stark diskutierte Vorfrage der Ethik und Metaethik nach der Natur moralischer Intuitionen. Las epistemologías de la manigua como metodología implican un diálogo interepistémico entre el método genealógico y las mañas de Tío Conejo, Ananse, Miguel Caicedo, Jaime Arocha, Sergio Mosquera, Lydia (...) Cabrera, en especial, Rogerio Velásquez. La oralidad representa potentes guayacanes3. Putting laypeople in an active role as direct expert contributors in the design of service robots becomes more and more prominent in the research fields of human–robot interaction and social robotics. Currently, though, HRI is caught in a dilemma of how to create meaningful service robots for human social environments, combining expectations shaped by popular media with technology readiness. We recapitulate traditional stakeholder involvement, including two cases in which new intelligent robots were conceptualized and realized for close interaction with humans. (...) Thereby, we show how the robot narrative together with aspects of power balancing stakeholders, such as hardware constraints and missing perspectives beyond primary users, and the adaptivity of robots through machine learning that creates unpredictability, pose specific challenges for participatory design processes in HRI. We conclude with thoughts on a way forward for the HRI community in developing a culture of participation that considers humans when conceptualizing, building, and using robots. (shrink)

However, through the playful footpaths of enchanted Galician Meigas, I rehabilitate some relevant discussion on the justification of belief formation and come to some poignant philosophical insights regarding the understanding of possibilities. In this paper, I will be primarily concerned with moral issues regarding future people and the environment. When it comes to the future, we have deontological and epistemic limitations. The closer to the present, the higher the certainty and the knowledge we have about facts. Thus, when we intend to find moral clarity regarding a future scenario, we deal with an inverse relation between certainty and time. The main problem is that most ways of dealing with moral issues about future (...) scenarios do not address this relation, and rather focus on things that seem to simplify and clarify the uncertainties of the future. In response to this, I propose a different approach, one that operates neutrally and timelessly dealing with the uncertainties of the future while providing moral groundings that can help to clarify the future’s state of moral vagueness. Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

Esta investigación se presenta como un aporte a los estudios culturales de Rapa Nui a partir de un análisis de caso: la serie de fotografías de 1914 que documentan un evento multitudinario en Rapa Nui y donde varias personas aparecen disfrazadas con máscaras de lona. Complementando diversas fuentes y métodos –como fotografías, dibujos, análisis visual, bibliografía y entrevistas–, este artículo busca esclarecer el contexto y los sentidos posibles de lo que hemos denominado como una escena-puzzle, esto es, una escena de (...) la cual se intenta reconstruir una imagen general buscando fragmentos en diferentes fuentes de información. En este trabajo de desenmascaramiento representamos este evento como una fiesta de carácter nacional que incluyó elementos del repertorio cultural contemporáneo de las personas rapanui. (shrink)

This paper studies the effects of social comparison on risk taking behavior. In our theoretical framework, decision makers evaluate the consequences of their choices relative to both their own and their peers’ conditions. We test experimentally whether the position in the social ranking affects risk attitudes. Subjects interact in a simulated workplace environment where they perform a work task, receive possibly different wages, and then undertake a risky decision that may produce an extra gain. We find that social comparison matters (...) for risk attitudes. Subjects are more risk averse in the presence of small social gain than social loss. In addition, risk aversion is decreasing in the size of the social gain. (shrink)

We propose that marketing of unhealthy foods and beverages to Black and Latino consumers results from the intersection of a business model in which profits come primarily from marketing an unhealthy mix of products, standard targeted marketing strategies, and societal forces of structural racism, and contributes to health disparities.

In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . Im Zuge einer Änderung des Arzneimittelgesetzes im November 2016 hat der Deutsche Bundestag beschlossen, dass gruppennützige Arzneimittelforschung mit nicht-einwilligungsfähigen Erwachsenen unter bestimmten Bedingungen erlaubt sein soll. Das entsprechende Gesetz wird voraussichtlich im Jahr 2020 in Kraft treten. Das ethische Problem dieser Forschung besteht darin, dass Personen, die nicht in der Lage sind, ihre Einwilligung in die Forschung zu erteilen, nicht vom medizinischen Fortschritt ausgeschlossen werden sollen. Der Gesetzgeber hat versucht, diesen Konflikt zu lösen, indem er die Zulässigkeit der gruppennützigen Forschung (...) mit nicht-einwilligungsfähigen Erwachsenen an die Voraussetzung geknüpft hat, dass Studienteilnehmer ihre Einwilligung zuvor in einer Probandenverfügung erteilen. Der Beitrag hat das Ziel, die neue Regelung zur gruppennützigen Forschung mit nicht-einwilligungsfähigen Erwachsenen aus ethischer Sicht zu bewerten. Die Frage, ob die Gesetzesänderung weitere Forschung ermöglichen wird, hängt wesentlich davon ab, ob man mit Blick auf Studien, die sowohl eigennützige als auch gruppennützige Maßnahmen umfassen, eine Gesamtbetrachtung oder eine Einzelbetrachtung dieser Studien vorzieht. In unserem Beitrag argumentieren wir für eine Einzelbetrachtung. Es wird weiterhin die Auffassung vertreten, dass die im Gesetzgebungsverfahren vorgeschlagene Probandenverfügung die Selbstbestimmung der Patienten fördern kann, wenn sie mit Blick auf die mit der Teilnahme verbundenen Eingriffe ein Mindestmaß an Bestimmtheit erreicht.Zusammenfassend wird die Auffassung vertreten, dass gruppennützige Forschung mit nicht-einwilligungsfähigen Erwachsenen trotz der genannten Bedenken unter bestimmten Bedingungen ethisch zulässig sein kann. In der Gesamtabwägung erscheint dabei die eindeutige Definition und strenge Beachtung der Bedingungen der EU-Verordnung 536/2014 mit Blick auf einen ethisch gerechtfertigten Einbezug von nicht-einwilligungsfähigen Erwachsenen in gruppennützige Forschung als besonders bedeutsam. Faria (2021) presenta una extraordinaria discusión sobre temas que rara vez suelen entrelazarse en la tradición analítica: el cambio en el contenido mental, su relevancia para la validez inferencial y las consecuencias que esto tiene para la responsabilidad (tanto en la acción como en el pensamiento). La meta de Faria (2021) es defender que la impermanencia del contenido, la vulnerabilidad de nuestras inferencias, el azar y la falta de control en nuestros pensamientos y acciones forman parte ineludible de nuestra forma (...) de vida. En este trabajo argumentaré que dichos argumentos son exitosos, aunque pondré en duda las consecuencias específicas que Faria (2021) obtiene de estos, argumentando que si bien hay impermanencia, vulnerabilidad y azar, no son tan radicales como para afectar nuestra concepción intuitiva de contenidos, creencia y racionalidad. We argue that moral judgment studies currently conducted utilizing virtual reality (VR) devices must confront a dilemma due to how virtual environments are designed and how those environments are experienced. We begin by first describing the contexts present in paradigmatic cases of naturalistic moral judgments. We then compare these contexts to current traditional (vignette-based) and VR-based moral judgment research. We show that, contra to paradigmatic cases, vignette-based and VR-based moral judgment research often fails to accurately model the situational features of (...) paradigmatic moral judgments. In particular, we compare and contrast six recent VR studies to support our view that only simulations high in context-realism and perspectival-fidelity can produce ‘virtually real experiences.’ After analyzing the constituents of a virtually-real experience, we go on to propose guidelines for the creation of VR studies. These guidelines serve two purposes. First, we aim to increase the ecological validity of such studies in order to advance our understanding of moral judgments. Second, we believe that such guidelines should inform how Institutional Review Boards assess VR research. We show that our guidelines are urgently needed given the current lax review standards in place. (shrink)

In Arequipa, Peru’s second largest city, engineers work hard to control water flows and provide different sectors with clean and sufficient water. In 2011, only 10 percent of the totality of water used daily by Arequipa’s then close to 1 million people—in households, tourism, industry, and mining—was treated before it was returned to the river where it continues its flow downstream towards cultivated fields and, finally, into the Pacific Ocean. It takes specialized knowledge and manifold technologies to manage water and (...) sustain life in Arequipa, and engineers are central actors for making water flow. Examining the ecology of water management, this article asks to what extent we can talk of a way of knowing and enacting water that is particular to engineers. Through engineering practices, a technical domain emerges as separate from and superior to political and social domains. This production of categories can be understood as practices of purification. However, a purely technical grip on water is never possible. Unruly elements, like weather, contamination, urban dwellers, and competing interests, interfere and make processes of intervention unstable. Water is never completely cleaned, and, equally, the continuous processes of purification of categories and domains take place while other processes work to blur their boundaries. (shrink)

Although the main responsibility for informed consent of medical procedures rests with doctors, nurses’ roles are also important, especially as patient advocates. Nurses’ preparation for this role in settings with a hierarchical and communal culture has received little attention. We explored the views of hospital managers and nurses regarding the roles of nurses in informed consent and factors influencing these roles. We conducted a qualitative study in a private, multispecialty hospital in Indonesia. Semi-structured interviews were conducted with seven managers. Two (...) rounds of focus group discussions with nurses (n = 27) were conducted. Constant comparative approach was used in the analysis. Nurses can act as manager, witness, information giver, and advocate in the informed consent process. These roles are influenced by nurses’ preparedness, hospital culture and policy, patients’ understanding, family involvement, and cost-related issues. In preparation for these tasks, nurses should acquire communication skills, clinical knowledge, and legal and ethical knowledge. (shrink)

This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)

Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria.
